Legal Agreement

Disputes subject to Monument Valley Safari’s negotiation, mediation, and arbitration clauses shall be governed by and interpreted in accordance with the laws of the State of Utah, the laws of the Navajo Nation, the laws of the Navajo Nation Parks & Recreation Department, and the Commercial Arbitration Rules of the American Arbitration Association. The parties herein acknowledge that this agreement evidences a transaction involving interstate and intergovernmental commerce. The United States Arbitration Act, Title 9 of the US Code shall govern the interpretation, enforcement, and proceedings pursuant to the negotiation, mediation, and arbitration clauses within Monument Valley Safari’s legal agreement.

Arbitration Clause

Any and all disputes concerning this contract, the brochure and or a clients’ rendered services shall be resolved solely and exclusively by binding arbitration (non-binding negotiation or mediation) according to the then current commercial rules of the American Arbitration Association. Any such arbitration will take place in Salt Lake City, Utah. In such arbitration, the substantive (but not procedural) law of the Utah State Courts will apply. The arbitrator and not any federal, state or local court agency shall have exclusive authority to resolve and dispute relevant interpretation, applicability, enforceability, conscionability and or formation of this contract, including but not limited to any claim that all or any part of this contract is void or voidable.

Negotiation Clause

In the event of any dispute, claim, question, or disagreement arising from or concerning this agreement or the breach thereof, the parties hereto shall use their best efforts to settle the dispute, claim, question, and or disagreement. To this effect, they shall consult and or negotiate with each other in good faith and, recognizing their mutual interests, attempt to reach a just and equitable solution satisfactory to both parties. If no mutual concession is determined within a period of 60 days, then, upon notice by either party to the other, all disputes, claims, questions, and or differences shall be formally settled by arbitration superintended by the American Arbitration Association in accordance with the provisions of its Commercial Arbitration Rules.

Mediation Clause

If a dispute arises out of or relates to this contract, or the breach thereof, and if the dispute cannot be settled through negotiation, the parties agree first to try in good faith to settle the dispute by mediation administered by the American Arbitration Association under its Commercial Mediation Procedures before resorting to litigation or alternative resolution procedures. Therefore, the parties hereby submit the following dispute to mediation administered by the American Arbitration Association under its Commercial Mediation Procedures.

(MVS) holds exclusive copyright ownership of all content provided within monumentvalleysafari.com, including all photographs, and intellectual property assets, unless otherwise stated, trademarked, or watermarked. The MVS name, logo and related trademarks and service marks, owned by Monument Valley Safari Inc., are registered and compliant with the State of Utah Department of Commerce under the Division of Corporations & Commercial Code, Article 9. All other trademarks, service marks and trade names referenced in this site are the property of their respective owners. Any use, copying or reproduction of the trademarks, logos, information, images and or designs contained herein monumentvalleysafari.com is strictly prohibited without the prior written permission of MVS.


MVS grants permission to media entities and journalists only to use MVS content and materials for editorial and/or news purposes in newspapers, periodicals and electronic and/or broadcast media related to MVS or its products and/or services. No other use of MVS materials is permitted and no other person(s) and/or entities are authorized to use MVS content and/or material herein monumentvalleysafari.com, including use in connection with the advertisement, promotion and/or sale of any products and/or services, unless prior written notice is obtained from MVS.


The intellectual property assets of MVS may not be altered and/or modified in any way. By using MVS content and/or material, the authorized media entities agree to comply with all restrictions, conditions and requirements set forth herein or provided by MVS independently. The permission granted herein may be revoked by MVS at any time without cause and upon providing notice of revocation to the agent.


MVS content and material is provided as is and without any warranties of any kind either express, implied, or statutory. MVS will have no liability whatsoever for your use of MVS content and material. Your use of MVS content and material constitutes your acceptance of this Media Policy. If you do not agree to these terms, do not copy, download or use any of MVS’s content and/or material property assets. Monument Valley Safari’s Media Policy shall be governed by and interpreted in accordance with US Copyright Laws & Regulations under Title 17 of the US Code and the then current Commercial Arbitration Rules of the American Arbitration Association.
